Richard joined Rottenberg Lipman Rich in June 2011. He is a litigator with a wealth of experience in all aspects of commercial litigation, representing clients in both state and federal district courts, mediation and arbitration, and corporate investigations.
At Rottenberg Lipman Rich, Richard has handled numerous cases in a variety of matters, including general commercial litigation, bankruptcy, trade secrets and restrictive covenants, employment discrimination, intellectual property, enforcement of foreign judgments, and art law. He has represented, among others, financial services companies, electronic payment businesses, and real estate companies in breach of contract disputes and actions for other alleged misconduct.
As to bankruptcy matters, Richard represented, among others, a large class of institutional and individual investors in several fraudulent conveyance actions relating to the Tribune Company bankruptcy, and several other clients with respect to preference actions.
In employment-related matters, he represents companies and employees regarding misappropriation of trade secrets and restrictive covenant litigation, as well as in defending against employment discrimination claims, both in state and federal courts and in arbitration.
In the field of art law, Richard represents art galleries, artists, and other interested parties in art-related lawsuits and disputes, including concerning authenticity and copyright and other intellectual property issues.
From 2007 to 2011, Richard was of counsel in the litigation department of Milbank, Tweed, Hadley & McCloy LLP (now Milbank LLP), where he also worked as an associate attorney from 1996 to 2002. Before rejoining Milbank, Richard served as an Assistant United States Attorney in the Civil Division of the United States Attorney’s Office for the Southern District of New York from 2002 to 2007.
Among Richard’s successful representations are:
- A market research company in an employment discrimination suit that was dismissed on several grounds;
- The co-owner of a consumer products company in a dissolution proceeding and declaratory judgment action concerning ownership of intellectual property, which settled favorably during trial;
- A well-known artist in a copyright and trademark dispute with an apparel company;
- A quantitative trading company in an arbitration claiming misappropriation of trade secrets against one of its traders;
- The co-owner of a leading beverage company in three breach of contract and tort actions in New York state and federal courts;
- A foreign-owned media company in a breach of contract and trademark infringement action;
- A reinsurance broker sued in New Jersey state court for fraud and other alleged misconduct;
- A hedge fund manager sued for violations of RICO; and
- Two groups of underwriters and investment companies sued in two separate actions in New York federal court for various securities violations.
While at the United States Attorney’s Office, Richard represented the United States in several constitutional and statutory challenges to various federal laws and regulations, as well as in employment discrimination, environmental, bankruptcy, tax and tort matters. Richard also led civil investigations into and prosecuted civil fraud claims, including healthcare fraud, and represented the United States in a civil prosecution based on the illegal importation of drugs. Richard received the prestigious Attorney General’s John Marshall Award for Alternative Dispute Resolution for his work on the resolution of a significant commercial dispute involving a United States Department of the Navy organization in mediation.
